Terms of Service

Thank you for using Eightpotions (“Eightpotions,” “we,” “us,” or “our”). Our mission is to help people create and share moodboards that inspire daily moods and creativity.

These Terms of Use (“Terms”) govern your access to and use of the Eightpotions website, applications, and services (collectively, the “Service”). If you do not agree, you must not use the Service.

1. Agreement and acceptance

By creating an account (including via email login or via third-party providers such as Google Sign-In), or otherwise accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 13 years old to use the Service. By using Eightpotions, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

3. Description of the Service

Eightpotions is a social platform that allows users to create, share, discover, and remix moodboards composed of styled text, images, stickers, and similar creative elements.

Eightpotions supports the following moodboard visibility settings:

• Public: published to the community and discoverable by everyone on the Service.
• Unlisted: accessible to anyone who has the link and intended to be shared privately with friends, collaborators, or clients. Unlisted moodboards are not intended to be broadly discoverable through the community.
• Private: visible only to the owner, subject to technical, legal, and security limitations. We do not guarantee absolute confidentiality.

Public and Unlisted moodboards may be eligible for duplication and editing by other users within the Service as “Remixes,” as described in these Terms. Private moodboards are not available for remixing by other users.

The Service may also include discovery features, search, recommendations, sharing tools, and editor features that help users create, find, use, and remix content within the Service.

4. Accounts and Authentication

• You may create an account using:
  • Email login: you provide your email address and receive a secure, time-limited login link to access your account. No password is required.
  • Google Sign-In: subject to your Google settings, we receive your name and email address.
• You are responsible for safeguarding your account and all activity that occurs under it.
• You are responsible for maintaining control of access to your email account, as it is used to authenticate access to the Service.
• You must not share your credentials or allow unauthorized access.
• You may not create accounts, access the Service, or collect information using automated, deceptive, or unauthorized means without our prior written permission.

5. User content and content rules

5.1 User Content

You retain ownership of the content you submit, post, upload, duplicate, edit, or display on the Service (“User Content”), including moodboards and stickers, subject to the licenses granted in these Terms.

If another user remixes your Public or Unlisted moodboard as permitted by these Terms, that Remix does not transfer ownership of your original User Content to that other user.

You are solely responsible for your User Content and any consequences of posting, sharing, or making it available for remixing.

5.2 Content Rules

You agree not to post, upload, share, remix, or otherwise make available:

• NSFW or sexual content: Explicit or pornographic content is strictly prohibited.
• Private or confidential information: Including personal data of others without permission.
• Infringing or illegal content: Content that violates intellectual property rights (copyright, trademark, privacy, publicity, or other rights) or applicable laws.
• Abusive or harmful content: Harassment, threats, hate speech, or discriminatory behavior.
• Impersonation or misleading content: Including content intended to misrepresent an individual, brand, source, endorsement, affiliation, or authorship.

We may remove content that violates these Terms and take enforcement action, including account suspension or termination.

5.3 Remixing Public and Unlisted Moodboards

If you make a moodboard Public or Unlisted, other users may be able to duplicate it and create edited versions of it within the Service (“Remixes”).

By making a moodboard Public or Unlisted, you grant other users of the Service a non-exclusive, worldwide, royalty-free license to copy, reproduce, adapt, edit, and create derivative works from that moodboard solely within the Eightpotions Service.

This license:

• is limited to use within the Service;
• allows other users to duplicate and modify the Public or Unlisted moodboard as part of creating a Remix within the Service;
• does not by itself authorize downloading source assets, extracting individual elements for separate reuse outside the Service, sublicensing, selling, or otherwise exploiting the moodboard outside the Service; and
• does not by itself grant any right to use the original moodboard or any Remix for commercial purposes outside the Service.

At this time, a Remix may be displayed without showing the original creator’s username. We may, but are not obligated to, identify, link, or otherwise associate a Remix with the original moodboard inside the Service.

If you create a Remix, you are solely responsible for your Remix and any content you add, remove, edit, arrange, or combine in that Remix. You must not create or share a Remix in a way that infringes rights, violates applicable law, or falsely implies sponsorship, endorsement, collaboration, or authorship by the original creator.

If a Public or Unlisted moodboard is deleted or later changed to Private, it will no longer be available for new Remixes. However, existing Remixes created before that deletion or visibility change may remain available on the Service unless removal is required by law, for safety reasons, or for enforcement of these Terms.

6. Acceptable use of the Service

You agree to use the Service only for lawful, personal, and non-abusive purposes. In particular, you must not:

• Access, scrape, crawl, or collect data from the Service using automated means without our prior written permission;
• Attempt to create accounts, interact with the Service, or bypass safeguards using bots or scripts;
• Interfere with or disrupt the integrity, performance, or security of the Service;
• Attempt to extract, export, or bulk-copy moodboards, stickers, or other content from the Service except as expressly permitted by features we provide.

7. Stickers: visibility, sharing, and reuse

This Section applies to stickers uploaded by users (“Stickers”).

7.1 Uploading Stickers and Rights You Must Have

When you upload a Sticker, you represent and warrant that you own the Sticker or have all necessary rights, licenses, consents, and permissions to upload it and (if you make it available to others) allow it to be used as described within the Service.

You must not upload Stickers that contain another person’s image, name, or likeness (or other personal data) without their permission, or that otherwise violate privacy or publicity rights.

7.2 Sticker Visibility and In-Service Use

You may choose whether a Sticker is Public or Private.

• Public Stickers may be accessible to other users within the Service and may be used by other users inside the editor and inside moodboards within the Service.
• Private Stickers are intended to be accessible only to you and are not available for use by other users.

If you make a Sticker Public, you grant other users of the Service a non-exclusive, worldwide, royalty-free license to use and display that Sticker solely within the Eightpotions Service and only as permitted by the features of the Service.

This license does not authorize downloading, exporting, sublicensing, selling, modifying the underlying Sticker artwork outside the ordinary editor functions, or using the Sticker outside the Service.

7.3 No Unauthorized Modification of Stickers

Users may not edit or modify the underlying Sticker artwork except to the extent allowed by the ordinary editor functions of the Service, such as placement, resizing for layout, layering, or rotating as part of a moodboard.

7.4 Deleting Stickers and Effect on Existing Moodboards

If you delete a Sticker or change it from Public to Private, it may no longer be available for new uses by other users. However, moodboards that already include the Sticker may continue to display it, subject to legal requirements, safety needs, and enforcement of these Terms.

Notwithstanding the above, we may remove or restrict access to Stickers or moodboards where required by law, for safety reasons, or for Terms enforcement.

8. Sharing outside the Service and commercial use

If you export, screenshot, record, publish, or otherwise share a moodboard outside Eightpotions, including a moodboard you created by remixing another user’s Public or Unlisted moodboard, you are responsible for ensuring you have all necessary rights to do so for every element included (including images, text, Stickers, and any content incorporated from another user’s moodboard).

Commercial use: Moodboards that include other users’ Stickers or content incorporated through the Remix feature are not cleared for commercial use by these Terms. If you want to use such a moodboard commercially, you are responsible for obtaining permission from the relevant rights holders and any other necessary permissions.

9. Rights you grant to us

To operate and improve the Service, you grant Eightpotions a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, store, reproduce, modify (for technical and formatting purposes), distribute, display, and create derivative works of your User Content, consistent with your privacy and application settings.

This license ends when your content is deleted from our systems, subject to reasonable technical limitations (such as backups or caching for a limited period), subject to Section 7.4 regarding Stickers included in existing moodboards, and subject to Section 5.3 regarding existing Remixes of Public or Unlisted moodboards created before deletion or visibility change.

Nothing in these Terms transfers ownership of your content to us.

10. Usernames and identifiers

If you select a username or similar identifier, we may modify or reclaim it if necessary (for example, for legal compliance, impersonation, inactivity, or intellectual property concerns).

11. Enforcement, suspension, and termination

We reserve the right (but not the obligation) to monitor, review, remove, restrict, or disable content at our discretion, including original moodboards, Remixes, and Stickers, and to suspend or terminate accounts that violate these Terms or applicable law.

You may stop using the Service and permanently delete your account at any time through Settings → Account. Account deletion is irreversible and ends your access to the account. Associated account data and User Content will be handled as described in our Privacy Policy. Existing Remixes and existing uses of Public Stickers may remain as described in Sections 5.3, 7.4, and 9.

If your account is suspended or terminated, you may contact us using the contact details provided in Section 19 to appeal. We will review appeals but do not guarantee reinstatement.

12. Copyright and IP complaints

If you believe content on the Service infringes your copyright or other intellectual property rights, please contact us using the contact details provided in Section 19 with sufficient information to identify the work and the allegedly infringing material.

13. Privacy

Please review our Privacy Policy to understand how we collect, use, and protect your information.

14. Disclaimers and limitation of liability

• No warranties: The Service is provided “as is” and “as available,” without warranties of any kind.
• Service availability: We do not guarantee uninterrupted or error-free operation.
• Visibility and sharing risks: Public and Unlisted content may be copied, shared, or remixed by others as allowed by the Service and these Terms. We are not responsible for how other users may access, share, or use content that you choose to make available beyond Private visibility, except as required by law.
• Limitation of liability: To the maximum extent permitted by law, Eightpotions will not be liable for indirect, incidental, consequential, or punitive damages, or loss of data, profits, or goodwill.
• Where liability cannot be excluded, it will be limited to the maximum extent permitted by applicable law.

15. Indemnification

You agree to indemnify and hold harmless Eightpotions and its affiliates, officers, employees, and agents from any claims, damages, losses, and expenses arising out of or related to your use of the Service, your User Content, your Remixes, your Stickers, or your violation of these Terms or applicable law.

16. Changes to the Terms

We may update these Terms from time to time. Material changes will be posted with a new effective date. Continued use of the Service after changes constitutes acceptance.

17. Governing law and jurisdiction

These Terms are governed by French law. Any dispute arising from or relating to these Terms or the Service shall fall under the exclusive jurisdiction of the French courts.

18. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
